Terms of Service

Outvia helps you plan and run cold email outreach. It analyzes a website you provide, suggests an ideal customer profile and messaging, drafts email sequences, stores your contacts and campaigns, and sends emails through sending accounts that you connect, such as your own SMTP mailbox or Resend account. Outvia does not provide its own shared sending infrastructure or a prospect database.

AI-generated content is a draft. You are responsible for reviewing, editing, and approving every campaign before you start it. Nothing sends until you start a campaign.

• You must be at least 18 years old and provide accurate account information.
• You are responsible for keeping your login credentials secure and for all activity under your account and workspaces.
• Tell us right away at hello@getoutvia.com if you believe your account has been accessed without permission.

When you connect a sending account, you authorize Outvia to use the credentials you provide to send emails, run test sends, check DNS records, and, if you enable it, read replies from the inbox you configure. You confirm you have the right to use that account and domain for this purpose.

You are the sender of every email sent through your account. You are solely responsible for the content of your emails, your contact lists, and your compliance with the laws and the email provider terms that apply to you, including CAN-SPAM, GDPR, the UK GDPR, CASL, and the ePrivacy rules in your recipients' countries.

Your use of Outvia must follow our Acceptable Use Policy, which is part of these terms. We may pause campaigns, disable sending, or suspend accounts that violate it, that generate excessive complaints or bounces, or that put our service or other customers at risk.

New accounts start with a 14-day free trial with Growth plan features. No payment card is required to start the trial. When the trial ends, your existing data stays visible, but you cannot add new data or send emails until you choose a paid plan.

• Paid plans are billed in advance on a recurring monthly basis at the price shown when you subscribe. Payments are processed by Stripe, Inc. We do not store your full card number.
• Each plan includes the limits shown on the pricing page, including monthly email sends and AI generations. When you reach a limit, the related feature pauses until the next billing period or until you upgrade.
• You can upgrade, downgrade, or cancel at any time from Settings, Billing. Cancellation stops future renewals. Your plan stays active until the end of the period you have already paid for.
• Fees are non-refundable except where required by law or where we state otherwise in writing.
• We may change prices or plan limits with at least 30 days notice by email or in the app. Changes apply from your next billing period.
• If a payment fails, we may limit sending or other features until the balance is paid.

You keep all rights to the content you put into Outvia, including your contacts, campaigns, templates, and replies. You grant us a limited license to host, process, and transmit that content only to provide and improve the service for you. Our Privacy Policy explains how we handle personal data.

You confirm you have a lawful basis and any required notices or consents for the contact data you upload and the emails you send.

Outvia uses third-party AI models to analyze websites and draft content. AI output can be inaccurate, incomplete, or similar to content produced for others. Check facts, claims, and personalization before sending. Monthly AI generation limits depend on your plan.

We work to keep Outvia available and reliable but do not guarantee uninterrupted service or inbox placement. Deliverability depends on your domain, your sending provider, your content, and your recipients. We may add, change, or remove features over time.

Outvia is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim relating to Outvia is limited to the amount you paid us in the 12 months before the claim arose.

You agree to defend and indemnify JI Tech LLC against claims, fines, and costs arising from your emails, your contact data, your breach of these terms or the Acceptable Use Policy, or your violation of any law.

You can stop using Outvia and cancel at any time. We may suspend or end your access if you breach these terms, fail to pay, or create legal or security risk. After termination you can request an export or deletion of your data by emailing us. We may delete workspace data after a reasonable retention period.

These terms are governed by the laws of the State of Florida, United States, without regard to conflict of law rules. We may update these terms. If a change is material, we will notify you by email or in the app before it takes effect. Continued use after the effective date means you accept the updated terms.
